The Closing Loopholes Law – officially known as the Fair Work Amendment (Closing Loopholes) Act 2023 and 2024 – will introduce significant changes to Australia’s employment laws.

The law is made up of two parts which addresses a number of new and existing aspects of Australian employment law – with Part 1 passing through Parliament in December 2023, and Part 2 recently passing in February 2024. Once implemented, these changes will have a major impact on Australian employers and employees.

As an employer, understanding these changes is crucial to ensure your workplace policies and practices are up to scratch – and to avoid heavy penalties that are being introduced.
